Swift Air Conditioning & Refrigeration Services — Terms of Service

1. Acceptance of Terms
By accepting this quotation (whether in writing, via email, or verbal confirmation), the client acknowledges that they have read, understood, and agreed to these Terms of Service. Approval of the quotation constitutes a binding service agreement between Swift Air Conditioning & Refrigeration Services (“Swift Air”) and the client (“the Customer”).
2. Scope of Work
The services to be provided are as detailed in the approved quotation. Any additional work, materials, or changes requested after acceptance will constitute a variation and may result in additional costs. Variations will be quoted separately and require customer approval before commencement.
3. Pricing and Payment

All prices are quoted in South African Rand (ZAR) and are valid for 14 days from the date of issue unless otherwise stated.

A 50% deposit is required upon acceptance of the quotation before work commences.

The balance is payable immediately upon completion of the work, unless otherwise agreed in writing.

Ownership of all supplied equipment remains with Swift Air until full payment is received.

Late payments may incur interest at 2% per month from the due date until settlement.
4. Site Access and Delays
The Customer agrees to provide Swift Air and its technicians with reasonable access to the property and working area during standard business hours.
Swift Air shall not be held liable for any delays or additional costs arising from:

Restricted access,

Third-party interference,

Delays caused by other contractors, load shedding, or unforeseen circumstances beyond Swift Air’s control.
5. Equipment and Warranties

All air conditioning units and materials supplied by Swift Air are covered by the manufacturer’s warranty, subject to correct usage and maintenance.

Installation workmanship carries a 12-month warranty from the completion date.

Warranties are void if equipment is tampered with, moved, or serviced by non-Swift Air personnel, or if recommended maintenance is not performed.
6. Liability
Swift Air shall not be held responsible for:

Pre-existing electrical faults, plumbing, or structural issues.

Damage caused by misuse, negligence, or environmental factors (e.g., power surges, flooding, or lightning).

Indirect, consequential, or incidental damages arising from use or failure of the equipment.
Swift Air’s liability shall in all cases be limited to the value of the service or product provided.
7. Cancellations
If the Customer cancels the job after acceptance:
- If materials have been ordered or work has commenced, the Customer is liable for the full cost incurred up to that point.
8. Maintenance and Service
Routine maintenance is the Customer’s responsibility unless covered under a separate service agreement. Failure to maintain the system as recommended may affect performance and warranty validity.
9. Health, Safety & Compliance
Swift Air follows all applicable South African occupational health and safety standards (OHS Act). Customers must ensure a safe working environment free of hazards for Swift Air personnel.
10. Governing Law
These Terms of Service shall be governed by and interpreted according to the laws of the Republic of South Africa. Any disputes arising shall be subject to the jurisdiction of the South African courts.
11. Acceptance
By accepting the quotation or proceeding with the scheduled work, the Customer acknowledges acceptance of these Terms of Service in full.
